General Terms and Conditions (T&C)

§ 1 Scope and Contracting Parties

1.1 Scope

These General Terms and Conditions (hereinafter "T&C") apply to all contracts for the delivery of goods and services concluded between The Beauty of Sound GmbH (hereinafter "Seller" or "we") and a customer (hereinafter "Customer" or "you").

1.3 Deviating Conditions

Deviating, conflicting, or supplementary general terms and conditions of the customer shall not become part of the contract unless we have expressly agreed to their validity in writing.

1.4 Consumers and Business Customers

Consumer within the meaning of these T&C is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.

Business customer is a natural or legal person or a partnership with legal capacity that acts in the exercise of their commercial or independent professional activity when entering into a legal transaction.

§ 2 Contract Conclusion and Ordering

2.1 Product Presentation

The presentation of products on the website does not constitute a legally binding offer, but rather an invitation to place an order. Product descriptions in catalogs and on our websites do not constitute an assurance or guarantee.

2.2 Ordering Process

The customer can select products from our range, e.g., in our online shop, without obligation and collect them in a so-called shopping cart via the "Add to Cart" button. The order process is initiated via the "Checkout" button or similar functions.

The ordering process includes the following steps:

  1. Selection of desired products
  2. Entry of delivery and billing address
  3. Selection of payment method
  4. Review of all information
  5. Binding submission of the order by clicking "Place Order" or similar buttons

2.3 Contract Language and Contract Storage

The language available for contract conclusion is German. The contract text is not stored by us after contract conclusion. We recommend that you print or save the order confirmation and these T&C.

2.4 Order Acceptance

By submitting the order, the customer makes a binding offer to purchase the goods in the shopping cart. We initially send an automatic receipt confirmation by email, which does not yet constitute acceptance of the offer.

The contract is only concluded by:

  • Sending an express order confirmation by email or
  • Delivery of the goods or
  • Request for payment within 5 days after sending the order

2.5 Custom-Made Products

Since our Sarasvati audio furniture are manufactory products that are individually manufactured to order, detailed coordination of specifications with the customer usually takes place before the binding order confirmation. In this case, the contract is only concluded with the express written or electronic order confirmation after coordination has taken place.

§ 3 Prices and Payment Terms

3.1 Prices

All stated prices are final prices and include the statutory value-added tax. Shipping costs may also apply, which are specified separately in the respective product description or at the latest during the order process.

3.2 Shipping Costs

In addition to the stated prices, we charge shipping costs for delivery within Switzerland and to EU countries. The shipping costs will be clearly communicated to you in the order form and in the order confirmation.

Note: For individually manufactured audio furniture, free delivery, installation, and instruction are usually provided. Details are specified in the individual offer.

3.3 Payment Methods

The following payment methods are available to the customer:

  • Advance payment/Bank transfer: After order confirmation, you will receive our bank details. The goods will only be produced and shipped after receipt of payment.
  • Invoice: You can pay by invoice. The invoice amount is due within 14 days after receipt of the goods.

3.4 Down Payment for Manufactory Products

When ordering individually manufactured audio furniture, full payment of the total price may become due. The remaining amount is due before or upon delivery. Details are specified in the individual offer.

3.5 Payment Default

If the customer defaults on payment, we are entitled to claim default interest at a rate of 5 percentage points above the base rate. For business customers, the default interest rate is 8 percentage points above the base rate.

§ 4 Delivery and Shipping

4.1 Delivery Area

We deliver within Switzerland and to the following countries: Germany, Austria, France, and Italy. Other EU countries are possible.

4.2 Delivery Times

The delivery of our audio furniture takes place after production with a delivery period of 8-12 weeks. Goods that are in stock are usually delivered within a few working days.

Manufactory Products: Since our Sarasvati audio furniture is individually manufactured for you, the delivery time is usually 8-12 weeks from order confirmation. The exact delivery time will be communicated to you in the individual offer.

4.3 Partial Deliveries

Partial deliveries are permitted insofar as this is reasonable for the customer.

4.4 Delivery and Installation

For audio furniture from the Sarasvati series, delivery usually includes professional installation and instruction by our specialists. The date and details are agreed in good time before delivery.

4.5 Delivery Delays

If delivery of the goods is impossible or unreasonably delayed due to an event for which we are not responsible, we are entitled to withdraw from the contract. You will be informed immediately and payments already made will be refunded.

§ 5 Retention of Title

The delivered goods remain our property until full payment. For consumers, retention of title expires at the latest upon full payment of the purchase price for the delivered goods.

For business customers, the following applies: The delivered goods remain our property until all claims from the ongoing business relationship have been fully settled. The customer is not entitled to pledge the goods under retention of title or transfer them as security.

§ 6 Warranty and Guarantee

6.1 Statutory Warranty

The statutory warranty rights apply. The limitation period for warranty claims is two years for newly manufactured items and one year for used items from delivery of the goods.

6.2 Defects

If the delivered goods are defective, you are first entitled to the rights of subsequent performance (repair or replacement delivery). If subsequent performance fails, you can either withdraw from the contract or reduce the purchase price.

6.3 Manufacturer's Guarantee

In addition to the statutory warranty, we grant the following guarantee on our Sarasvati audio furniture:

  • 5-year guarantee on all mechanical and structural components of the furniture
  • 3-year guarantee on all electronic components and speakers
  • 2-year guarantee on surfaces with normal use

Important: The guarantee covers material and workmanship defects. Damage caused by improper handling, normal wear and tear, or force majeure is excluded. Detailed guarantee conditions will be provided with delivery.

6.4 Complaints

Please check the delivery immediately upon receipt for completeness and obvious defects. Defects must be reported to us immediately, but at the latest within 14 days after receipt of the goods, in writing.

§ 7 Right of Withdrawal for Consumers

Consumers generally have a right of withdrawal. Information on the right of withdrawal can be found in our withdrawal policy.

Important Note: There is no right of withdrawal for products individually manufactured according to customer requirements (custom-made products). This particularly applies to our Sarasvati audio furniture, which is manufactured according to individual specifications.

§ 8 Liability

8.1 Scope of Liability

We are liable according to statutory provisions insofar as the damage is based on an intentional or grossly negligent breach of duty by us, our legal representatives, or vicarious agents.

In case of simple negligence, we are only liable for:

  • Damage from injury to life, body, or health
  • Damage from breach of essential contractual obligations (cardinal obligations)

8.2 Limitation of Liability

In case of breach of essential contractual obligations through simple negligence, our liability is limited to the contract-typical, foreseeable damage.

8.3 Product Liability

Liability under the Product Liability Act remains unaffected.

§ 9 Copyright and Intellectual Property

All contents of this website as well as our product designs are protected by copyright. Reproduction, editing, distribution, and any kind of exploitation outside the limits of copyright law require written consent.

In particular, the following designs and designations are protected:

  • Sarasvati - Product designation and design
  • The Beauty of Sound - Brand and logo
  • All product photos and technical drawings

§ 10 Data Protection

We process your personal data in accordance with the provisions of the Swiss Data Protection Act (DSG) and the EU General Data Protection Regulation (GDPR). Detailed information on data processing can be found in our privacy policy.

§ 11 Dispute Resolution

11.1 Contact Us

In case of complaints, you are welcome to contact us first. We will endeavor to find a solution together with you. In addition, you have access to corresponding consumer protection organizations in Switzerland and finally to legal recourse.

§ 12 Final Provisions

12.1 Applicable Law

Swiss law applies to all legal relationships between us and the customer, excluding the UN Sales Convention (CISG). For consumers, this choice of law only applies insofar as the protection granted by mandatory provisions of the law of the state of the consumer's habitual residence is not withdrawn.

12.2 Place of Jurisdiction

If the customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between the customer and us is Lucerne, Switzerland. The same applies if the customer does not have a general place of jurisdiction in Switzerland or the EU or if their place of residence or habitual residence is not known at the time the action is filed.

For consumers: The statutory places of jurisdiction may also be decisive.

12.3 Contract Language

The contract language is German.

12.4 Severability Clause

Should individual provisions of these T&C be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision whose effects come closest to the economic objective pursued by the contracting parties with the invalid or unenforceable provision.

12.5 Changes to the T&C

We are entitled to change these T&C with effect for the future. Changes will be communicated to you in good time. If you do not object within 6 weeks after receipt of the change notification, the changed T&C shall be deemed accepted. We will specifically point out this consequence in the change notification.
